Investigation of NDPS Cases

OBJECTIVE

The Investigating Officer (IO) shall focus on:

  1. Strict compliance with mandatory provisions of the NDPS Act.

  2. Collection and preservation of scientific, documentary, and electronic evidence.

  3. Detection of narcotic trafficking networks and organized crime.

  4. Arrest of offenders and dismantling of supply chains.

  5. Prevention of acquittals due to procedural lapses.

  6. Conducting a professional, fair, and legally sustainable investigation.


IMPORTANT LEGAL PROVISIONS

The IO shall strictly comply with:

  • Section 8 NDPS Act – Prohibition of certain operations.

  • Sections 20, 21, 22 – Possession, transportation, sale, and trafficking.

  • Section 27A – Financing illicit traffic and harboring offenders.

  • Section 29 – Criminal conspiracy and abetment.

  • Section 35 – Presumption of culpable mental state.

  • Section 37 – Restrictions on bail.

  • Section 41 – Power to issue warrant and authorization.

  • Section 42 – Search, seizure, and arrest in building, conveyance, or enclosed place.

  • Section 43 – Search and seizure in public place.

  • Section 50 – Conditions for personal search.

  • Section 52 – Disposal and handling of arrested persons and articles.

  • Section 52A – Disposal, inventory, photography, and sampling before Magistrate.

I. RECEIPT OF INFORMATION

A. Secret Information

When information is received regarding possession, transportation, concealment, or sale of narcotic drugs:

  1. Reduce the information into writing immediately.

  2. Record:

    • Date.

    • Time.

    • Source information.

    • Place.

    • Suspect details.

  3. Forward the written information to the immediate superior officer forthwith.

Mandatory Compliance

Where Section 42 applies:

  • Written information must be recorded.

  • Information must be communicated to superior officers.

Failure to comply with Section 42 may vitiate prosecution.


II. FORMATION OF RAID PARTY

  1. Form a competent raiding team.

  2. Include:

    • Gazetted Officer wherever possible.

    • Independent mediators.

    • Woman Police Officers where female suspects are involved.

If search is conducted in:

  • House.

  • Building.

  • Enclosed premises.

  • Private vehicle.

Section 42 NDPS Act shall apply.

The IO shall:

  1. Record information in writing.

  2. Inform superior officers.

  3. Conduct search lawfully.


IV. COMPLIANCE OF SECTION 50 NDPS ACT

PERSONAL SEARCH

Before personal search of a suspect:

The accused shall be clearly informed that:

"You have a legal right to be searched before a Gazetted Officer or a Magistrate."

The option shall be:

  • Explained clearly.

  • Communicated in understandable language.

  • Recorded in writing.

Important

  1. Obtain written reply of accused.

  2. If accused opts:

    • Produce before Gazetted Officer or Magistrate.

  3. Maintain documentary proof.

Non-compliance of Section 50 may render recovery illegal and may result in acquittal.

Note

Section 50 applies to personal search and not necessarily to bags, vehicles, or premises unless personal search is involved.


V. SCENE OF OFFENCE PROCEDURE

  1. Secure the scene.

  2. Collect Geo-Location Coordinates.

  3. Conduct photography and videography.

  4. Prepare:

    • Observation Panchanama.

    • Rough Sketch.

  5. Record:

    • Position of accused.

    • Location of contraband.

    • Witness details.

    • Vehicle details.


VI. SEIZURE OF CONTRABAND

The IO shall:

  1. Weigh the entire contraband.

  2. Record:

    • Gross weight.

    • Net weight.

    • Packing details.

    • Markings.

  3. Mention:

    • Colour.

    • Texture.

    • Smell.

    • Packaging material.

  4. Conduct field testing wherever available.


VII. SAMPLING PROCEDURE (SECTION 52A NDPS ACT)

Mandatory Procedure

The IO shall:

  1. Prepare inventory of seized property.

  2. Produce seized contraband before Magistrate.

  3. Seek certification of:

    • Inventory.

    • Photographs.

    • Samples.

  4. Draw samples in presence of Magistrate.

  5. Obtain Magistrate certification.

Failure to comply with Section 52A may seriously affect prosecution.


VIII. SEALING AND CUSTODY

  1. Seal bulk contraband.

  2. Seal samples separately.

  3. Mention seal particulars in Panchanama.

  4. Prepare specimen seal.

  5. Maintain chain of custody.

The Malkhana Register shall contain:

  • FIR Number.

  • Date of deposit.

  • Quantity.

  • Seal particulars.


IX. REGISTRATION OF FIR

  1. Register FIR under appropriate provisions.

  2. Send FIR copies to:

    • Court.

    • Superior officers.

    • Concerned units.

  3. Hand over FIR copy to complainant where applicable.


X. ARREST OF ACCUSED

  1. Arrest accused in accordance with law.

  2. Follow:

    • Section 41 CrPC/BNSS.

    • Constitutional safeguards.

  3. Prepare:

    • Arrest Memo.

    • Personal Search Memo.

    • Grounds of Arrest.

  4. Inform family members.


XI. INVESTIGATION

The IO shall investigate:

Source of Contraband

  • Supplier.

  • Transporter.

  • Financier.

  • Receiver.

Technical Evidence

Collect:

  • Mobile phones.

  • SIM cards.

  • CDRs.

  • Tower locations.

  • WhatsApp chats.

  • Social media communications.

  • Bank transactions.

Vehicle Investigation

Collect:

  • RC.

  • Insurance.

  • Permit.

  • Ownership records.


XII. REPORT UNDER SECTION 57 NDPS ACT

Within the prescribed period:

  1. Submit report of:

    • Arrest.

    • Seizure.

    • Recovery.

  2. Forward report to superior officer.

Courts frequently examine compliance with Section 57 during trial.


XIII. FORENSIC EXAMINATION

The IO shall send samples to:

  • FSL.

  • Chemical Examiner.

The forwarding letter shall contain:

  • Seal details.

  • Sample details.

  • Case particulars.

The IO shall obtain:

  • Chemical Analysis Report.

  • FSL Report.


XIV. EXAMINATION OF WITNESSES

Record statements of:

  • Panch witnesses.

  • Gazetted Officer.

  • Magistrate (where necessary).

  • Raiding party.

  • Independent witnesses.

  • Vehicle owners.

  • Property owners.


XV. SPECIAL INVESTIGATION POINTS

The IO shall investigate:

  • Organized syndicates.

  • Interstate networks.

  • Financing under Section 27A.

  • Criminal conspiracy under Section 29.

  • Previous criminal history.

  • Foreign links.

  • Dark web transactions.

  • Cryptocurrency transactions.


XVI. PROPERTY DISPOSAL

Follow Section 52A NDPS Act.

  1. Obtain Magistrate certification.

  2. Follow Government disposal guidelines.

  3. Maintain destruction records.

  4. Preserve samples and documentation.


XVII. COURT PROCEEDINGS

The IO shall:

  1. Oppose bail under Section 37 NDPS Act where applicable.

  2. File applications for:

    • Police Custody.

    • Remand extension.

    • Verification of sureties.

  3. Maintain liaison with Public Prosecutor.


XVIII. CHARGE SHEET

Before filing charge sheet ensure:

  • Compliance of Sections 42, 50, 52A, 55, and 57.

  • FSL report obtained.

  • Inventory certified.

  • Samples properly accounted for.

  • Chain of custody established.

  • Witness statements completed.

The Draft Charge Sheet shall be vetted by PP/APP wherever required.


RESPONSIBILITY OF THE INVESTIGATING OFFICER

The IO shall ensure:

  1. Strict compliance with NDPS statutory safeguards.

  2. Scientific seizure and sampling.

  3. Proper documentation of every procedural step.

  4. Preservation of chain of custody.

  5. Timely FSL examination.

  6. Effective investigation of source, supply chain, and financing.

  7. Strong prosecution through legally admissible evidence.


IMPORTANT CAUTION

The courts have repeatedly held that:

  • Total non-compliance of Section 42 is impermissible.

  • Strict compliance of Section 50 is mandatory for personal search.

  • Section 52A sampling and inventory procedures must be followed.

  • Failure in mandatory safeguards may result in acquittal despite recovery.
